The products and services ("Services") provided by Arkmont ("Us") covered by these Terms and Conditions ("Terms") govern your use of Services, not limited to the website, apps, and other services. By signing up you are agreeing to accept all of these terms and conditions. By using our Services you also agree to be bound by these Terms, including but not limited to additional policies that may be referenced in these Terms.
"You" means you as a User of Arkmont.
"User" is anybody who signs up on Arkmont's website, apps or other technologies.
"Us" means Arkmont.
"Terms" means this term document, and additional policies.
"Services" means Arkmont's products and services.
"Teacher" means you, if you have started creating a course.
"Partner" means a person who Arkmont has chosen to work with.
"TA" means Teacher Assistant, a person who helps manage and maintain a course.
Anybody can use our Services if they can accept a binding contract with Arkmont and can comply with local, regional and national laws. You must also be 13 years of age or older. In addition, some courses offered may require ages 18 or older. You also agree to only use and maintain one single account.
By accepting these Terms we are granting you a limited, personal, non-exclusive, non-transferable and revocable license to use our Services. Simply using our Services does not give you ownership or permission to reproduce material such as courses, images, design, videos, articles or any other content found when using our Services, including intellectual property, copyrights, trademarks, written content or course names.
Arkmont reserves the right to refund, pause, cancel, suspend, remove and modify your enrollment in any course at any time. Arkmont can also modify, delist, unpublish and remove courses, course material, downloadable content, students, teacher assistants and teachers from any course. Course modifications can also include, but are not limited to course coupons, pricing, reviews, lesson reviews, titles, modules and more.
Courses are both free and paid. Prices on courses are in U.S. Dollars and are dictated and maintained by the teachers and creators of courses, however course prices may be modified.
Completing a course may result in a new certificate of completion that's credited to your account. The course certificate does not count towards academic credit.
By enrolling in any course, you are becoming a student of the teacher(s) of the course. Your objective should be to complete the course and learn as much as you can from each course you enroll in.
If you enroll in a paid course and find you do not like it, you can request a refund within 30 days. Your request for a refund will be denied after the 30 day period.
When you enroll in a course you are agreeing to share your email address with the teacher whose course you've enrolled in. Arkmont takes great care in finding the right teachers who are knowledgeable and trustworthy.
Refunds for enrollment into paid courses can be requested within 30 days. When you request a refund, Arkmont reserves the right to keep your questions, comments, discussion points and reviews in the course however you will not receive notifications, emails or updates from the refunded course.
You retain, and are responsible for, all intellectual property rights regarding the content you share, write, teach or otherwise put on Arkmont.
While security is a high priority for Us and we work to continue providing higher security for You, we cannot guarantee that unauthorized personnel will not beat our security. If there is any compromised data or unauthorized use on your account please contact Us immediately.
If you start creating a course, you are considered to be a teacher. Teacher is a title, not an employment opportunity. By becoming a teacher You are agreeing that you are not an employee of Arkmont and that you are, instead, an independent contractor.
Teachers will earn up to 70% of each sale, even in cases where a coupon code was used. In the case of courses with multiple teachers, the combined revenue percent may not exceed 70%. In some scenarios, a teacher may partner with Arkmont and can earn more than 70%. Arkmont reserves the right to selectively choose who becomes a Partner and the higher revenue earning percent threshold that comes with the Partner title.
All courses have a price and in the case of a free course the price is treated as $0.00. Course prices are maintained by Teacher but may be modified by Arkmont. When changing a course from free to paid, the course may undergo an internal audit to ensure the course is worth the specified price and that the would-be paid course is not breaking any terms of conditions set forth herein by these Terms.
All uploaded, written, recorded and shared content by Teacher is the full responsibility of Teacher and reflects on the course and the teachers reputation. Arkmont reserves the right the remove content that violates these Terms.
No content created, shared, written or recorded by Teacher shall be inappropriate, racist, offensive, sexist, incorrect, false, hateful, pornographic, defamatory or misleading in any way. Any content found to break these conditions may be removed without warning, and in the case of multiple content removals the course may undergo an internal audit and may be removed entirely.
You may not share, create, write, record or influence students to click advertisements, spam, join pyramid schemes or join multi-level marketing. You also agree that you will not force a student, TA or teacher to sign up for any service (free or paid) outside of Arkmont for the benefit of knowledge, profitability or gained status. Affiliate links are not tolerated. You may suggest purchases to students but they should never be required to further, or complete, their education inside your course.
All content must be free of viruses, malware and all other forms of damaging programming or visual harm.
As a teacher, You will not:
Teachers will be paid in the month following the 30 day refund period. As an example: if you earned $3,000 in July, the Student has 30 days to request a refund which brings the timeline to the end of August. You will be paid in September for July's sales. This is to ensure requested refunds by students are accepted and you never owe money to Arkmont.
A Teacher Assistant is not liable for course material but is liable for the written, shared, uploaded, recorded or other means of assisting the teacher(s) of a course.
TA's are not able to accept pay for helping teachers in any courses. If a teacher wants to pay their TA's, they will have to do so outside of Arkmont. Arkmont is not responsible for the acts of payment to or from a TA.
Courses you create are non-exclusive and may be reproduced, shared, marketed and advertised on your behalf at the sole expense of Arkmont. The material and information inside your course is yours, and is to be free of copyright and intellectual property infringement. If the course you've created is original work then Arkmont acknowledges the content to be your property.
Prices of a course on Arkmont must be between $9.00 and $999.99, in U.S. dollars. Courses with a price of $0.00 are considered free and require no payment.
Coupons created by Teacher is considered the the responsibility of the teacher. Teacher is liable for coupon codes.
Arkmont is not liable for content that any user shares. In addition, any content third party users, companies or groups of people share is not the responsibility or liability of Arkmont.
If you find any content that is clearly copyright protected, trademark protected or infringing on intellectual property please contact Us immediately.
Any content that is shared by Student, Teacher or otherwise that is found to be infringing on protected material will be removed and accounts may be suspended or removed with no chance of refunds.
Everybody owns their own content but is also liable and responsible for their own content.
You agree to indemnify, defend, and hold harmless Arkmont from all expenses, liabilities, damages and claims, including attorney fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User shared content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
